The current R E I Q contracts for purchase or sale of property contain clauses (11. 3) (11.5) and (12.1) which need to be considered at the beginning of your intention to act. The situation is that you, either as the intending seller or the intending purchaser, occupy a vital position in the agreement. Without your agreement to the manner in which the transaction takes place there is no deal.

Of recent times the solicitors or agents have attempted to introduce new measures which deprive the buyer and seller of this freedom and lessen the required jobs for the solicitor. They now speak of ‘electronic signing’ and ‘electronic settlement’ which is not necessary from your point of view.
These matters are included in the contracts. ‘Electronic signing’ Is the signing of the contract and ‘electronic settlement’ is the final passing of payment and possession. The ‘electronic settlement’ clause advises that either party has the right to decline that method of settlement by advising the other party or their solicitor of their decision and crossing through the clause, and initialling. We suggest that your option to decline ‘electronic signing’ be made known to the real estate agent right from the beginning before either party signs their intention to buy or sell. You are the customer. Tell the real estate agent your decision.
