When a perrson dies their possessions immediately become the property of the Queensland State Public Trustee. At no time are the items, once the sole property of a person now deceased, without an owner.

If the deceased had made a Will nominating an executor that person should apply to the Supreme Court to be granted Probate, which is the right and authority to deal with the possessions as stipulated within the Will.

In many cases the deceased may have had a small value bank account in his own name. This may be written in the Will to go directly to the surviving partner.

Upon the production of the official death certificate, and after viewing the Will, the bank could be prepared to release the funds to the surviving partner. If the funds are more substantial then the bank  will probably require to see the official Grant of Probate as well, before releasing the funds.

Under these circumstances just applying for Probate and receiving the Grant of Probate or obtaining Letters of Administration (either with or with-out the Will) can be all that you need to do. This is not too difficult a task and you just need to obtain a simple 'Application for Probate or Letters of Administration' kit.

When transfering house, land or community title property from vendor to purchaser the use of written contracts is required. Transferring to friend or family through real estate agent or directly you still need contracts. R.E.I.Q contracts are recognised as being fair & acceptable to both buyer and seller. 

R E I Q contracts, sometimes known as 'House Contracts' or 'Land Contracts', are not available to you from the offices of the law firms and the real estate agencies unless you are using their services. The contracts they have usually already have the name of the agent or solicitor imprinted within the contract.. Those contracts are neither available nor suitable for persons planning to handle their own conveyancing.

If you are handling the contracts then with a little more effort you can complete the full transaction. Many people complete the full conveyancing process themselves and really save big money. In Queensland the Land Titles Office will only record transactions  where written contracts are exchanged except for very, very rare occasions. They are not interchangeable so do not order the wrong ones.

Intending buyers or sellers are wise to obtain a contract early so they have time to study the clauses and understand them before being required to sign. If you are selling it means that an early, interested party can be signed up quickly.
